Need legal opinion on a possible trade name conflict between my U.S. company and a Canadian company.
The trade name in question is for a new product (ours) that is still in development stage (not too late to change it if we are obviously in the wrong). The Canadian company has a business name (not a product) that is similar to our product name. The opinion I am looking for should offer a description of the risk that we may be open to, how we can reduce it if such risk is high and how we might respond to a cease and desist if we receive such a notice in using the desired tradename.
I will provide links to both web sites and a brief description of our intended product market and use.
Provider is expected to have functional understanding of U.S. and Canadian tradename and copyright law.
The expected deliverable is expected to range from a brief opinion ranging from one to several paragraphs with some legal references and or comparative case examples.
