I having been trying to collect a debt from a virtual hosting company located in Totowa, New Jersey area. I have been chasing after an invoice with a value of about US $2,700 since December 2011. They have remitted a partial payment of $1,000 in April 2012, but haven't paid the remaining balance since then.
I have sent a demand letter through a US attorney and hired a collection agency but to no avail. Since the amount is not that much and I am located in Hong Kong, they probably anticipate that it will not be cost justified to take them to court.
What I plan to do is to file a claim to the commercial small claim court for not just the outstanding amount, but also the interest and the legal charge involved (if possible). I need a proposal from an attorney in the New Jersey area to provide an estimates of the total cost involved including your fee and the legal fee. Do you accept payment on a fixed cost and/or contingency basis? Also, does the fee includes locating and filing a levy on their bank?
