Build an html5 audio player

Hello, I want to build a button html5 player, I have already the flash version of it and I want exactly the same of it in html5. Features : - Secure, no one can copy it and post it in another website. - Detect when the user have a browser able to read the html5, it shows it else It will shows the flash player. - Have exactly the same design and flash effect that are in the flash version. - It should be scalable, because in some pages it appears in size : 23px * 13px and in some others the size is 39px * 39px. That's all ! let you show me what you can do !
